Welcome to Pacifica !

By booking a private catamaran excursion with us, you agree to the following terms and conditions :

1. Reservation and Payment :
To secure your booking, a non-refundable deposit is required at the time of reservation. This deposit must be done by PayPal (no need any account, a permalink payment methode is sent to your personal email adress). The remaining balance is due at the boarding. The outstanding participation payment can be done either by cash or credit card method. Any credit card payment loads a 13% fees as sales taxe, it only apply for credit card payment method. A PayPal balance payment would load only 7% fees.
***Failure to make full payment by the due date may result in the cancellation of your booking.***

Changes to Booking :
Any requests to change your booking, including dates or itinerary, must be made in writing and are subject to availability. Additional fees may apply.

2. Cancellations and Refunds :
– Client-Initiated Cancellations: If you cancel your reservation more than 5 days before your scheduled departure, you may receive a partial  refund, minus the non-refundable deposit. Cancellations made within 5 days of the departure date are non-refundable.
– Company-Initiated Cancellations: In the unlikely event that Pacifica must cancel your reservation due to unforeseen circumstances, you will receive a full refund of all payments made, including the deposit.
However, we are not responsible for any additional costs you may incur as a result of the cancellation.


3. Liability and Insurance
Pacifica is not liable for any personal injury, loss, or damage to personal property during your rental period. We recommend that all guests purchase adequate travel insurance to cover any unforeseen incidents.


4. Behavior and Responsibility
You and your guests are responsible for the care of the catamaran during the rental period. Any negligent or reckless behavior that leads to damage or injury may result in additional charges.


5. Alcohol Consumption:
Moderation Required: Alcohol consumption on board is allowed but must be done in moderation. Each passenger is responsible for consuming alcohol responsibly.
Personal Responsibility: Passengers are accountable for their own behavior when consuming alcohol.
The crew reserves the right to limit or prohibit alcohol consumption if inappropriate behavior is observed.
No Underage Drinking: Consumption of alcohol by individuals under the legal drinking age of 18 (CostaRican law) is strictly prohibited.


6. Dangerous Behavior:
Zero Tolerance for Endangerment: Any behavior that endangers the safety of the vessel, crew, or other passengers, especially due to alcohol abuse, will be treated with the utmost seriousness.
Immediate Expulsion: If a passenger engages in dangerous or disruptive behavior due to alcohol or for any other reason, the crew reserves the right to disembark the passenger at the next port or return to the starting point without a refund.
– Medical Assistance: If a passenger is unable to care for themselves due to alcohol abuse, the crew may request emergency medical assistance at the passenger’s expense.


7. Liability and Indemnification:
Damage Responsibility: Passengers will be held liable for any damage to the vessel, equipment, or other passengers due to their behavior under the influence of alcohol.
Indemnification: The passenger agrees to indemnify and hold harmless the vessel owner, crew, and any related parties against any claims or legal actions resulting from their behavior on the vessel.
By completing your reservation with Pacifica, you acknowledge that you have read, understood, and agreed to these terms and conditions.
